Legal notice
Only the Catalan version of this document is legally binding, Catalan being the official language of the Principality of Andorra. This English version is a translation provided for convenience; in the event of any discrepancy, the Catalan text prevails.
Who operates this service
ValiraVPN is operated by a legal structure currently being formed in the Principality of Andorra. Until its entry in the Registre de Societats takes effect, that structure has no legal personality, and the service is operated by its founder, who carries its obligations. The company will take over all of them on the date of its registration.
This is a transitional situation and the service is open in beta.

Hosting
The infrastructure is administered by the operator on hardware he owns. It is entrusted to no third-party host. A relay in France forwards encrypted traffic to the origin server without being able to read it: the certificate's private key never leaves the origin.
What the service is
ValiraVPN is a virtual private network. It encrypts traffic between the subscriber's device and an entry node, then sends it out through an exit node of the subscriber's choosing. The exit nodes are supplied by a third-party decentralised network, Sentinel.
The service guarantees neither a given throughput nor the permanent availability of any particular exit: the exit network is made of machines run by independent third parties, which appear and disappear without notice. The number and location of available exits vary accordingly.
Price and invoicing
The price shown is inclusive of all taxes. No value added tax is currently applied, the structure not yet being liable for it. On the day it becomes liable, the tax will be taken out of the price already advertised: no supplement will be asked of existing subscriptions.
Payment is accepted in Monero only. The Monero amount is set at the rate of the day when the invoice is opened, and that rate holds for two hours.
An invoice is issued for every settled payment and is available as a PDF from the customer area. No copy is kept: the document is rebuilt on request from the accounting figures alone, which are frozen at the moment of issue.
Right of withdrawal
The service is supplied immediately once payment is confirmed. In accepting it, the subscriber expressly requests immediate performance and acknowledges losing the right of withdrawal once the service has been fully performed, in accordance with consumer law on digital content.
Where a fault is attributable to the service, the subscriber may ask for a refund by writing to the contact address.
Liability
The operator takes reasonable steps to keep the service running. He cannot be held liable for interruptions caused by third-party exit nodes, by transit networks, or by blocking put in place by states or access providers.
The subscriber alone remains responsible for the use he makes of the service and for complying with the laws that apply to him.
Intellectual property
The ValiraVPN name, the logo, the texts and the interface of this site are protected. The client software is distributed separately under its own licence.
Governing law
These notices are governed by Andorran law. Mandatory consumer protections in the subscriber's country of residence continue to apply and are not set aside by this clause.
